Terms of Service

1. Acceptance of Terms

By creating an account or using Monster Health ("the App," "we," "our," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the App.

2. Description of Service

Monster Health is a personal health tracking application that allows you to log symptoms, track health issues, manage appointments, store health-related information, coordinate care with family members through Care Circles, and access AI-powered health insights and chat features.

3. Not Medical Advice

Monster Health is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is designed to help you organize and track your health information for your own reference and to share with your healthcare providers.

AI-powered features, including chat and health insights, are for informational and organizational purposes only. They are not a substitute for professional medical judgment.

Always consult a qualified healthcare provider for medical advice. Never disregard professional medical advice or delay seeking it because of information provided by the App. If you are experiencing a medical emergency, call your local emergency number immediately.

4. Connectivity and Emergency Limitations

The App requires an active internet connection to function. Features including health logging, AI chat, Care Circle sharing, and data syncing are unavailable without connectivity.

Monster Health is not an emergency service. The App does not connect you to emergency responders, does not monitor your health in real time, and cannot send alerts on your behalf. Do not rely on the App in any medical emergency, time-sensitive health situation, or situation where loss of connectivity could impact your safety. Always call your local emergency number (such as 911) in an emergency.

We are not liable for any harm resulting from the App being unavailable due to network outages, device issues, server maintenance, or any other cause.

5. Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate and complete information during registration

  • Maintain the security of your account credentials

  • Notify us promptly if you suspect unauthorized access to your account

  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age to create an account. Parents and guardians may create Care Circle profiles to track health information for their minor children.

6. Care Circles

The Care Circle feature allows you to create profiles for family members and grant other users access to those profiles. When using Care Circles, you agree that:

  • You have the authority to create profiles for individuals you add (e.g., you are a parent, guardian, or authorized caregiver)

  • You are responsible for the accuracy of information you enter for Care Circle members

  • You control who has access to each Care Circle profile and can revoke access at any time

  • Granting someone access to a Care Circle profile allows them to view and, depending on their role, edit the health information associated with that profile

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose

  • Attempt to gain unauthorized access to any part of the App or its systems

  • Upload malicious content, viruses, or harmful code

  • Impersonate another person or misrepresent your identity

  • Use the App to store information about individuals without their knowledge or consent (except for minor children under your care)

  • Share your account credentials with others

  • Use the App in any way that could harm, disable, or impair the service

8. User Content

You retain ownership of all health data, notes, photos, and other content you submit to the App ("User Content"). By submitting User Content, you grant us a limited license to store, process, and display it solely for the purpose of providing the App's services to you.

We do not claim ownership of your health data. You can delete your User Content at any time through the App.

9. AI-Powered Features

The App includes features powered by artificial intelligence (currently provided by OpenAI). When using these features:

  • Health data you submit may be processed by third-party AI services to generate responses

  • AI-generated content is not reviewed by medical professionals and may contain errors

  • You should not rely on AI-generated content for medical decisions

  • AI features are optional and you can use the App's core tracking features without them

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

11. Subscription and Payments

Monster Health offers both free and premium subscription tiers. If you subscribe to a premium plan:

  • Payment is processed through the Apple App Store or Google Play Store

  • Subscriptions automatically renew unless cancelled before the renewal date

  • You can manage or cancel your subscription through your device's app store settings

  • Refunds are handled according to the policies of the applicable app store

We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period.

12. Availability and Modifications

We strive to keep the App available and functioning, but we do not guarantee uninterrupted or error-free service. We may:

  • Modify, update, or discontinue features at any time

  • Perform maintenance that temporarily limits access

  • Suspend or restrict access to the App if necessary for security or operational reasons

We will make reasonable efforts to notify users of significant changes to the App's functionality.

13. Intellectual Property

The App, including its design, code, branding, logos, and original content (excluding User Content), is owned by Monster Health and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

14. Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided "as is" and "as available" without warranties of any kind, either express or implied

  • We do not warrant that the App will be error-free, secure, or uninterrupted

  • We are not liable for any health decisions you make based on information in the App

  • We are not responsible for the accuracy or completeness of AI-generated content

  • Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

15. Indemnification

You agree to indemnify and hold harmless Monster Health, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these terms, or your violation of any rights of another person.

​

16. Account Termination

You may delete your account at any time through the App. Upon deletion, your data will be retained for 60 days, during which you can cancel the deletion request at any time from within the app. After 60 days, your data is permanently removed from our systems.

We reserve the right to suspend or terminate your account if you violate these terms, with notice where practicable. In the event of termination, you may request a copy of your data by contacting us at helpdesk@mymonsterhealth.com.

17. Dispute Resolution

If a dispute arises between you and Monster Health, we encourage you to contact us first at helpdesk@mymonsterhealth.com so we can attempt to resolve it informally.

If we are unable to resolve a dispute informally, you agree that any legal action will be brought in the courts of the State of Delaware, and you consent to the jurisdiction of those courts.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration against Monster Health.

18. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you through the App and require your agreement before you can continue using the service. Your continued use of the App after agreeing to updated terms constitutes acceptance of those changes.

19. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

20. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Monster Health regarding your use of the App, and supersede any prior agreements.
